The U.S. Department of Labor recently announced its long-anticipated changes to overtime rules under the Fair Labor Standards Act (FLSA).
Beginning January 1, 2020, employees who are considered “salaried” and exempt from the FLSA’s overtime pay provisions must earn a guaranteed minimum salary of at least $684/week ($35,568/year) in order to be treated as such. This is higher than the current threshold of $455/week, or $23,550/year.
Therefore, if an employee’s salary is not at least $684/week, he or she must receive overtime for all time worked over 40 hours in a week or receive an increase in salary to the new minimum level. Failure to do so will result in a violation of federal wage law.
